Protection of infringed client’s rights

Subject matter:

• protection of infringed client’s rights;
• cancellation of the Patent No. 27304 for the invention of “2-methyl-10- (4-methyl-1-piperazinyl) -4H-thieno [2,3-B] [1,5] benzodiazepine or an acid addition salt for the treatment of central disorders nervous system and intermediate”.

 Problems with registration:

• a violent fight at the courts of various instances between our client and a violator of his rights that was continuing more than 5 years;
• conducting several court’s examinations.

Problem solving:

• filing a suit with the court for protection of our client’s rights;
• preparation of many additional arguments;
• analysis of numerous materials on chemical subjects to prove the right of our client;
• conducting negotiations with experts in this field;
• filing of an appeal and comments on a cassation appeal;
• the offender has decided not to prolong the validity of the patent, thus automatically agreeing to its cancellation.

Result:

• the case is won;
• our client opens a branch in Ukraine;
• 16% of the turnover received by the company from the export of products to Ukraine;
• our client's plants produce 4.5 billion tablets, 140 million packets for medicines and 500-600 tons of active substances per year, 32% of which goes to Ukraine, that is a good indicator in terms of the number of world producers of pharmaceutical products;
• the net income of our client’s company in the financial years 2015-2016 was about 450 million euros, 73% of which came from export sales and 27% for sales in Hungary and Ukraine.
